Official Rules
1.NO PURCHASE OR PAYMENT OF ANY KIND
IS NECESSARY TO ENTER OR WIN. 2.INTRODUCTION: Perfect Performance Products,
LLC is offering the Painless LS Camino Giveaway Contest (the "Contest").
3. ELIGIBILITY: The Contest is open only to legal residents
of the 50 United States and the District of Columbia, who as of 5/1/06 are 18
years of age or older and who possess a valid driver’s license. Employees
of the Sponsor, its parents, subsidiaries, affiliated companies, and agents,
and the foregoing employees’ household or immediate family members (defined
as parent, spouse, child, sibling or grandparent) are NOT eligible to enter
the Contest. 4.TIMING: Contest begins at 12:01 a.m. Central
Time ("CT") on 5/1/06 and ends at 5:00 p.m. CT on 3/5/07 (the "Contest
Period"). 5.HOW TO ENTER: limit one entry per person/email
address. Entry allowed online via official Contest entry form only. To enter,
during the Contest Period correctly complete an official entry form (available
as detailed below) and type an essay in the space provided (recommended minimum
length of essay is 500 words, no maximum) telling us about your experience with
any Painless Product(s) and transmit as directed. The essay must be composed
solely by the participant (see Rule #7 for judging criteria). Please note that
all required information/fields on entry form must be fully and accurately completed
or entry may be voided. Official entry forms are available at www.painlessperformance.com
(scroll down to the Contest link). Sponsor reserves the right to include a Contest
official entry form at any additional authorized website. By submitting an entry
and an essay, a participant warrants and represents that entry/essay is unpublished,
truthful in all respects, does not violate any law, or regulation and does not
infringe or violate any third party rights, including but not limited to the
rights of copyright, trademark, privacy and publicity. Materials submitted become
the sole property of Sponsor and will not be acknowledged or returned. 6.PRIZE: One (1) prize will be awarded consisting
of a used, customized 1966 Chevy El Camino with an approximate retail value
("ARV") of $25,000. The winner must personally take delivery of the
prize vehicle at an award presentation at the first stop of the 2007 HOT ROD
Magazine Power Tour (the "Award Presentation"), at a time and at a
location determined by the Sponsors (but tentatively planned for 6/2/07) or
winner may forfeit any right to the prize and the prize may be awarded to the
next runner-up entrant. In order for the winner to travel to the Award Presentation,
the prize also includes: a) Coach class one-way airfare for the winner and a
guest ("Guest") to fly from a major gateway airport closest to the
winner's U.S. residence to the Award Presentation location (winner and Guest
must fly together); b) One-nights’ lodging (double occupancy). Above-mentioned
airfare will not be awarded if the winner resides within 300 miles of Award
Presentation location. The Guest for the Award Presentation trip must be 18
years of age or older at the time the Travel Companion Release referred to below
is executed. The award of the above-mentioned airfare and lodging is contingent
upon the winner attending the Award Presentation. All details regarding the
above-mentioned trip to the Award Presentation (including, but not limited to
trip dates, airline(s), flights, seats, hotel, and room) will be designated
solely by Sponsor, and may be changed at any time at Sponsor’s sole discretion.
The total ARV of the prize including the prize vehicle, airfare and lodging
is $25,900. The prize is nontransferable and must be accepted as awarded. No
cash or other substitution may be made, except by Sponsor in the event that
a prize or part thereof cannot be awarded for any reason; in such event, Sponsor
will in its sole discretion award a substitute prize or part thereof of equal
or greater value. Subject to the conditions herein, the prize will be awarded.
Winner is solely responsible for any and all applicable federal, state, and
local taxes (including where applicable sales tax) due for his/her awarded Contest
prize, as well as all applicable fees and expenses related to the acceptance,
award, and use of his/her Contest prize, including (but not limited to): vehicle
registration (including any modifications required for registration), license,
title, insurance, gas, vehicle maintenance, travel and health insurance, personal
expenses, meals, room service, telephone, gratuities, incidentals and any other
expenses not specifically listed herein. WINNER WILL ALSO BE RESPONSIBLE FOR
ALL COSTS INCURRED TO DRIVE OR SHIP THE PRIZE VEHICLE FROM THE AWARD PRESENTATION
TO THE WINNER’S RESIDENCE. Sponsor is awarding the prize vehicle on an
"AS-IS" basis without warranty, guaranty or representation of any
kind express or implied, including without limitation any implied warranty of
merchantability, fitness for a particular purpose, legality for use in the winner’s
State or compliance with emissions regulations. Winner may be required to present
valid driver’s license and satisfactory proof of insurance prior to prize
award. 7.JUDGING: Winner will
be selected from all eligible entries received (subject to sufficient entries).
The judges will be selected from the staff of the Sponsor and one other professional
organization. To determine the winner, the judges will use the following criteria:
relevance to theme (25%), creativity (25%), effectiveness (25%), originality
(15%), and commitment (10%). In the event of a tie, to break the tie, tied entries
will be judged on creativity only. Participants agree to be bound by these rules,
that winning is contingent upon fulfilling all requirements herein, and that
the decisions of the Sponsor and/or Contest judges shall be final and binding
in all respects. 8.NOTIFICATION: Potential winner will be
notified (the "Notification") by mail (or other method at the discretion
of Sponsor) on or about 3/15/07 and will be provided with a telephone number
that potential winner must call within 48 hours of receipt of Notification to
confirm eligibility and availability to travel to the Award Presentation. In
addition, within seven (7) days of Notification postmark, potential winner must
return ("Return") the below-listed documents via overnight delivery
as directed (plus any additional documents required at the discretion of Sponsors):
a) An Affidavit, Waiver, Release and Indemnity Agreement ("Agreement"),
including where lawful a Publicity Release (to be correctly completed and executed
by potential winner prior to said Return); b) A Travel Companion Release ("Release"),
including where lawful a Publicity Release (to be correctly completed and executed
by the Guest prior to said Return). If the initial Notification is sent via
email, an email reply from the potential winner must be received by the sender
of the initial email within five days of potential winner’s receipt of
the email (thereafter, the potential winner will be sent the Agreement/Release
and the above mentioned Agreement/Release deadline[s] will apply). Failure to
comply with the requirements of this paragraph (or the return of any prize or
prize notification as non-deliverable) may result in disqualification and in
the forfeiture of any right to a prize, in which case, prize may be awarded
to an alternate winner selected as per the judging criteria detailed herein.
9.E-MAIL ADDRESS: In the event of a dispute
regarding who submitted an online entry, the entry will be deemed submitted
by the person whose name is on the entry form. 10.RELEASE: By participating in the Contest
and/or accepting a prize, a participant/winner agrees to defend, release and
hold harmless the Sponsor and its parents, subsidiaries, affiliates, divisions,
advertising and promotion agencies, and the foregoing companies’ officers,
directors, shareholders, employees, representatives, agents and all others associated
with the development and execution of the Contest and the customization of the
Contest prize vehicle (collectively the "Releasees") from and against
any actions, claims and/or liability for injury, loss or damage of any kind
(including any for the violation or infringement of any proprietary or personal
right of any individual or entity) resulting in whole or in part, directly or
indirectly, from participation in the Contest, the use, acceptance, or possession
of a Contest prize, and/or participation in a Contest prize-related activity.
By participating in the Contest and/or accepting a prize, a participant/winner
consents to and gives the Sponsor the right to use a participant’s/winner’s
names, address, entry form information and submitted essay, to photograph/video
a winner and a winner’s property and in perpetuity to freely and exclusively
use, publish and display a winner’s statements, quotes, picture, portrait,
likeness, voice, video, biographical information, prize information, and winner-submitted
essay (in whole or in part, as may be adapted, edited or modified, as solely
determined by Sponsor) for advertising, trade, publicity and promotional purposes
in any media now known or hereafter discovered, worldwide, and on the World
Wide Web, without review, notification or approval, all without additional consideration,
unless prohibited by law. Entries will not be acknowledged or returned. 11.CONDITIONS: Participants agree that by
participating they release the Releasees from any liability in connection with:
a) Entries that are ineligible as a result of being lost, late, illegible, damaged,
incomplete, stolen, or misdirected; b) Any typographical or other human or technical
errors in the offer or administration of the Contest, including but not limited
to errors in advertising, these official rules, the selection and announcement
of a winner(s), or the distribution/awarding of a prize(s); c) Any omission,
interruption, deletion, defect, delay, misdirection, damage, injury, technical
malfunctions or traffic congestion on the Internet/telephone network, or at
any website, or any combination thereof. Sponsor reserves the right to modify
these rules for clarification purposes without materially affecting the terms
and conditions of the Contest. In the event that the Contest entry website is
infected by a computer virus/worm, or is not capable of running or being executed
as planned (as a result of but not limited to an error, omission, defect, delay,
misdirection, tampering, unauthorized intervention, fraud, action of participants,
or technical failure) or any other cause which in the sole opinion of Sponsor
corrupts or affects the administration, security, fairness, integrity, or proper
conduct of the Contest, Sponsor reserves the right in its sole discretion to
disqualify any suspect entry or participant and to cancel, terminate, modify
or suspend the Contest. In the event of such cancellation, termination, modification
or suspension, notice thereof will be posted at the entry website mentioned
herein, and the winner(s) will determined solely by Sponsor (based on above-mentioned
judging criteria) from among all eligible non-suspect and/or non-disqualified
entries. In such event, Releasees shall have no liability to any participant
who is disqualified due to such an action. Failure to enforce any term of these
official rules shall not constitute a waiver of that provision. 12.LAWS: Subject to all federal, state and
local laws and regulations. Void where prohibited or restricted. 13.WINNER’S LIST: A winner’s
list will be available by sending an SASE by 4/30/07 to: Painless LS Camino
